TI-Innovator™ Hub Software Single User License
APPLICATION: This Single User License applies to TI-Innovator™ Hub obtained in the United States or Canada.
IMPORTANT - Read this agreement (“Agreement”) carefully before using the Texas Instruments TI-Innovator™ Hub (“TIH”). The software program(s) installed on the TIH and materials accompanying it are licensed, not sold. By using the software program(s) contained on the TIH, you agree to be bound by the terms of this license. If you do not agree with the terms of this license, return the TIH and its package with all its contents to the place of purchase for a full refund.
The software program(s) in this installation and any related documentation (collectively referred to as the Program) are licensed, not sold, by Texas Instruments Incorporated (TI) and/or any applicable licensors (collectively referred to as Licensor). Specific details of the license granted are set forth below.
SINGLE USER LICENSE
Licensor grants to you a personal, non-exclusive, non-transferable license to install and use the Program on a TIH. You may make one copy of the software for backup and archival purposes. You agree to reproduce all copyright and proprietary notices shown in the software and on the media. Unless otherwise expressly stated in the documentation, you may not duplicate such documentation.
You agree that you will not reverse-assemble or reverse-compile the software program portion of the Program. This license shall automatically terminate in the event you attempt to reverse assemble or reverse-compile the software program portion of the Program or defeat any software protection mechanism contained within the software program portion of the Program. You may not sell, rent, lease or otherwise transfer the Program or any copies, whether in whole or in part.
If you meet the terms of the single user license you are also authorized to use any TIH application (App), for which you hold a valid license, with the Program.

Warranty. Licensor does not warrant that the Program will be free from errors or will meet your specific requirements. Any statements made concerning the utility of the Program are not to be construed as express or implied warranties.
LICENSOR MAKES NO CONDITIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED CONDITIONS OR WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, OR NON- INFRINGEMENT REGARDING THE PROGRAM AND MAKES THE PROGRAM AVAILABLE ON AN "AS IS" BASIS.
LICENSOR SHALL NOT BE RESPONSIBLE FOR ANY DAMAGES CAUSED BY THE USE OF THE PROGRAM, OR SUFFERED OR INCURRED BY YOU OR ANY OTHER PARTY INCLUDING BUT NOT LIMITED TO SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES OR PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
LICENSOR’S TOTAL AGGREGATE LIABILITY UNDER THIS LICENSE IS LIMITED TO 500 (FIVE HUNDRED) US$.
THE ABOVE LIMITATIONS OF LIABILITY FOR DAMAGES DO NOT APPLY IN CASE OF CAUSATION OF BODILY HARM DUE TO LICENSOR’S FAULT, IN CASE OF DAMAGES DUE TO LICENSOR’S GROSS NEGLIGENCE OR INTENT OR IF LICENSOR IS LIABLE UNDER MANDATORY PRODUCT LIABILITY LAWS.
GENERAL
This Agreement will immediately terminate if you fail to comply with its terms. Upon termination of this Agreement, you agree to return or destroy the original package and all whole or partial copies of the Program in your possession and so certify in writing to TI.
The export and re-export of United States original software and documentation is subject to the Export Administration Act of 1969 as amended. Compliance with such regulations is your responsibility. You agree that you do not intend to nor will you, directly or indirectly, export, re-export or transmit the Program or technical data to any country to which such export, re-export or transmission is restricted by any applicable United States regulation or statute, without the proper written consent or license, if required of the Bureau of Export Administration of the United States Department of Commerce, or such other governmental entity as may have jurisdiction over such export, re-export or transmission.
If the Program is provided to the U.S. Government pursuant to a solicitation issued on or after December 1, 1995, the Program is provided with the commercial license rights and restrictions described elsewhere herein. If the Program is provided to the U.S. Government pursuant to a solicitation issued prior to December 1, 1995, the Program is provided with "Restricted Rights" as provided for in FAR, 48 CFR 52.227-14 (JUNE 1987) or DFAR, 48 CFR 252.227-7013 (OCT 1988), as applicable.

En utilisant le (s) programme (s) logiciel (s) contenu (s) sur le TIH, vous acceptez d’être lié par les termes de cette licence.
Si vous n’acceptez pas les termes de cette licence, renvoyez le TIH, son progiciel et l’intégralité de son contenu au lieu d’achat afin d’être intégralement remboursé.
Le(s) programme(s) logiciel(s) dans cette installation et toute autre documentation afférente (ciaprès conjointement dénommé le “ Programme ”) sont concédés sous licence et non pas vendus par Texas Instruments Incorporated (TI) ni par un quelconque concédant de licence habilité (ciaprès dénommé conjointement le “ Concédant de Licence ”). Les informations spécifiques relatives à la licence accordée, sont établies ci-dessous.
LICENCE MONO-UTILISATEUR
Le Concédant de Licence vous accorde une licence personnelle, non exclusive, non cessible, vous permettant d’installer et d’utiliser les Programme sur un TIH. Vous pouvez effectuer une copie du logiciel en vue de le sauvegarder et de l’archiver. Vous acceptez de reproduire tous les droits d’auteur et les avis de propriété figurant sur le logiciel ou sur le support. Sauf spécification contraire prévue dans la documentation, vous ne devez pas dupliquer cette documentation.
Vous acceptez de ne pas démonter ni décompiler le programme logiciel, faisant partie du Programme. Cette licence prendra automatiquement fin si vous tentez de démonter ou de décompiler le programme logiciel, faisant partie du Programme ou si vous faites échouer un quelconque mécanisme de protection du logiciel contenu dans le programme logiciel, faisant partie du Programme. Vous ne devez pas vendre, accorder en location, louer ni céder d’une quelconque autre manière tout ou partie du Programme ou les copies que vous pouvez détenir.
Si vous respectez les termes de la licence mono-utilisateur, vous êtes également autorisé à utiliser une quelconque application de calcul de TIH (ci-après dénommée “ App ”), pour laquelle vous êtes titulaire d’une licence valide, avec le Programme.

LE CONCÉDANT DE LICENCE N’ACCORDE AUCUNE AUTRE CONDITION NI GARANTIE, EXPRESSE OU IMPLICITE, CE QUI INCLUT SANS POUR AUTANT S’Y LIMITER TOUTE CONDITION OU GARANTIE IMPLICITE RELATIVE À LA QUALITÉ MARCHANDE, AU CARACTÈRE APPROPRIÉ DU PROGRAMME À DES FINS PARTICULIÈRES ET À L’ABSENCE DE CONTREFAÇON DU PROGRAMME ET IL FOURNIT LE PROGRAMME EN L’ÉTAT.
LE CONCÉDANT DE LICENCE N’ASSUMERA PAS LA RESPONSABILITÉ DES DOMMAGES CAUSÉS PAR L’UTILISATION DU PROGRAMME OU QUE VOUS-MÊME OU UNE TIERCE PARTIE AVEZ SUBIS OU CONTRACTÉS, EN CE COMPRIS SANS POUR AUTANT S’Y LIMITER LES DOMMAGES SPÉCIAUX, INDIRECTS, ACCESSOIRES OU CONSÉCUTIFS, MÊME SI LE CONCÉDANT DE LICENCE AVAIT ÉTÉ INFORMÉ DE L’ÉVENTUALITÉ DE CES DOMMAGES.
ETANT DONNÉ QUE CERTAINS ÉTATS OU PROVINCES N’AUTORISENT PAS L’EXCLUSION OU LA LIMITE DES DOMMAGES ACCESSOIRES OU CONSÉCUTIFS NI LA LIMITE DE DURÉE D’UNE GARANTIE IMPLICITE, LES LIMITES OU EXCLUSIONS SUSMENTIONNÉES PEUVENT NE PAS S’APPLIQUER À VOTRE CAS.
DANS LE CADRE DE CETTE LICENCE, LE PLAFOND DE LA RESPONSABILITÉ GLOBALE DU CONCÉDANT DE LICENCE SE LIMITÉ À 500 (CINQ CENTS) DOLLARS ($) AMÉRICAINS.
LES LIMITES SUSMENTIONNÉES QUANT À LA RESPONSABILITÉ DES DOMMAGES NE S’APPLIQUENT PAS EN CAS DE BLESSURE CORPORELLE DUE À UNE FAUTE COMMISE PAR LE CONCÉDANT DE LICENCE, EN CAS DE DOMMAGES DUS À UNE FAUTE LOURDE OU À UNE TENTATIVE DE FAUTE LOURDE IMPUTABLE AU CONCÉDANT DE LICENCE OU SI LE CONCÉDANT DE LICENCE EST CONSIDÉRÉ COMME RESPONSABLE EN VERTU DES LOIS OBLIGATOIRES SUR LA RESPONSABILITÉ DU PRODUIT.
GÉNÉRALITÉS
Le présent Contrat prendra automatiquement fin si vous ne respectez pas ses termes. Après résiliation du présent Contrat, vous acceptez de restituer ou de détruire le progiciel d’origine et l’intégralité des copies complètes ou partielles du Programme que vous avez en votre possession et de le certifier par écrit à TI.
L’exportation et la réexportation du logiciel d’origine des Etats-Unis et de la documentation relèvent de la Loi de 1969 sur l’Administration des Exportations amendée. Il vous incombe de respecter ces réglementations. Vous acceptez de ne pas exporter, réexporter ni céder (ce qu inclut les tentatives pour ce faire), directement ou indirectement le Programme ou les données techniques dans un pays vers lequel l’exportation, la réexportation et la cession sont restreintes par une quelconque réglementation ou loi applicable aux Etats-Unis, sans le consentement ou le permis écrit accordé le cas échéant par le Bureau de l’Administration des Exportations du Département de Commerce des Etats-Unis ou par tout autre organisme gouvernemental ayant compétence sur l’exportation, la réexportation ou la cession.
Si le Programme est fourni au Gouvernement américain, à l’issue d’une requête déposée le 1er décembre 1995 ou à une date ultérieure, le Programme est fourni avec les droits et restrictions de licence commerciale décrits dans le présent. Si le Programme est fourni au Gouvernement américain, à l’issue d’une requête déposée avant le 1er décembre 1995, le Programme est fourni avec les “ Droits restreints ”, comme le prévoit la FAR, 48 CFR 52.227-14 (JUIN 1987) ou la DFAR, 48 CFR 252.227-7013 (OCT 1988), selon les cas.

(4) En caso de que alguna de las disposiciones de la presente Licencia o parte de éstas quedaran invalidadas, el resto de las disposiciones así como las partes restantes de las mismas seguirán surtiendo efecto. Cualquier adición o modificación de la presente Licencia deberá realizarse por escrito y ser firmada por un representante debidamente autorizado de TI. Esto también será de aplicación a cualquier renuncia al requerimiento de forma escrita establecido anteriormente.
(5) La presente Licencia constituye el íntegro y único acuerdo entre Vd. y TI.
Cualquier adición o modificación de la presente Licencia deberá realizarse por escrito y ser firmada por un representante debidamente autorizado de TI. Esto también será de aplicación a cualquier renuncia al requerimiento de forma escrita establecido anteriormente.
